Subject: TO ETHAN - 14/10/15...Hi Ethan.. Seidner: 2015/3329 [DLM=For-Official-Use-Only]

Dear Ethan
Thanks for your work and the effort your Department has put into doing things properly. Very much appreciated.

I am pleased to give my consent for your people to go ahead and to investigate matters as per below in your email to me of today’s date.

This formal commentary from me is in accordance with previous email from you – wherein you wrote as below inviting me to ‘’provide my input’’
This I have done to the best of my ability with consideration to a degree of understanding that I have gleaned of the workings of Family Law.

My earlier concerns were that Catholic Care would be able to respond to SOME of the points by claiming that they did no wrong [!] in [at least!] some of what they did and plainly allowed
Dr Howard Zeimer to do.

From my recollection is that Catholic Care theoretically could claim – as they did in one of their emails...   http://wilfullyblind.blogspot.com.au/2015/07/cc12-my-reply-to-nick-dated-july-23.html
that it is not their role to check the validity of the respective claims. SO TO SPEAK.
See this tangent immediately below:

‘’It is also completely inappropriate for Family Dispute Resolution Practitioners to corroborate, substantiate or validate one party’s version of events.
As such we cannot respond to your emails about the specific details of your situation. ‘’

It is obvious that this is plainly a thoroughly – discreditable idea. If it was correct – and with due consideration to the multiple resources in Family Law that plainly contradict it –
the entire MEDIATION / FDR process becomes a mockery.
Which is precisely what CATHOLIC CARE AND DR HOWARD ZEIMER COORDINATED!

I have indeed decimated every chimeric excuses from CATHOLIC CARE.
INCLUDING THE ABOVE HYPOTHETICAL ONE THAT COULD BE RAISED BY THEM AGAIN.

Indeed there were other matters of minor concern which do not seem to be important. All surely covered by thorough documentation should they DARE to raise same.
Manifestly the indictments if only this final version -  are devastating: they have indeed committed acts that are unfathomable. Illegal. outrageous.

I also note your and your department’s generosity of the inevitable duplications in these correspondences.

Once again – thank you all.

No doubt you will be able to email me and post as well the final papers as earlier discussed.
Regards
Geoff Seidner

‘’Dear Geoff,

As discussed, please see below the first draft of the key concerns that will be submitted to the area within the Department of Social Services that will assess if your complaint can be looked into.
As discussed with you on the phone, this is only a draft and I actively seek your input into the points below, please feel free to edit the words below also.

The key concerns listed below are focused on the areas where you feel you have had a negative experience with Catholic Care and I encourage you to add in any extra points that I may have
missed due to the complex nature of this enquiry.  Please be advised that all documents (emails, blogs etc) previously submitted by you will accompany your key concerns to the relevant
area within the Department of Social Services.’’

Dear Geoff,

I have been liaising with the team looking into your concerns and they have provided a response to your amended key concerns.  Please see their response below:
______________________________________________________________________________________________________________________________________

Thank you for your email of 30 September 2015 regarding the changes you are seeking to the key concerns that this Department have highlighted in the Complaints Recording Template.

The Department’s role in this matter is to look into your concerns to determine if the terms and conditions of the grant agreement between the Department of Social Services and CatholicCare Victoria Tasmania through CatholicCare Melbourne has been met.   The Department will consider how CatholicCare Victoria Tasmania responds to, and provides supporting evidence, regarding how it has acted in relation to the Family Dispute Resolution Service they provided to you.

The Department has noted your requested changes and we will accept the requested change to point 3 and change the word “mural” to “mosaic”.  However, the additional wording you have requested does not alter the Department’s capacity to assess the nine key issues in a timely manner and make a determination as to whether the organisation has met their grant agreement requirements.  Additionally as the Department is only able to investigate factual information which relate to the nine key concerns, we are unable to review information which could be perceived as opinion and/or subjective.

Please also note that the Department is only able to look into claims made against the grant recipient in this case CatholicCare Victoria Tasmania and is not able to contact any third party in this matter.

I am therefore seeking your agreement for the Department to proceed with the following nine issues which we have previously communicated with you.

1.       That Catholic Care failed in their primary duty of providing a balanced mediation between you and Mr Zeimer.
2.       That mediator Jenkins accepted claims by Mr Zeimer that you and your wife were causing alleged distress to your grandchildren when they were participating in scheduled visits to you.  And, that mediator Jenkins didn’t consider whether or not Mr Zeimer and his wife were actually causing unnecessary duress to the children.
3.       That mediator Jenkins failed to investigate whether or not alleged stress being experienced by the grandchildren was being caused by a mosaic, being constructed at their school, in honour of their deceased mother.
4.       That mediator Jenkins allowed mediation to proceed without acknowledgement of affidavits from Mr Zeimer, as well as relevant court documents (including explanations of the grandchildren’s medical ailments).
5.       That mediator Jenkins allowed mediation to proceed without allowing you the opportunity to point out Mr Zeimer’s claims against you, claims made years prior which were proven to be fraudulent by the family court.
6.       That mediator Jenkins did not consult with you and used her own initiative to ensure that you and your wife would not meet face to face with Mr Zeimer during mediation sessions.
7.       That based on a meeting with mediator Jenkins, Mr Zeimer stopped the grandchildren’s visits to you and your wife, despite court orders permitting scheduled visits.  These court orders were provided to Jenkins and they were ignored.
8.       That Catholic Care leaked your private documents with Catholic Care to Mr Zeimer.
9.       That Catholic Care and Gadens solicitors, wrote to the grandchildren’s school, banning you and your wife from visiting their school by misrepresenting Court Documents.

Kind Regards

Ethan
